[taken from an interwork email this morning....] Court to decide if Jesus existed January 25, 2006 - 6:43AM An Italian court will this week ponder the existence of Christ after an atheist accused a priest of misleading the public by presenting Jesus as an historical character. The atheist, 72-year-old Luigi Cascioli, first filed a complaint against 75-year-old Father Enrico Righi, a parish priest in Bagnoregno, central Italy, in September 2002. Righi had asserted the historical existence of Christ in a parish newsletter. "This complaint does not wish to contest the freedom of Christians to profess their faith ... but wishes to denounce the abuse that the Catholic Church commits by profiting from its prestige to present historical facts as if they are real when they are only inventions," the atheist says on his website. The trial, beginning Friday morning, will consider article 661 of the Italian penal code which, under the term "abuse of popular gullibility", sanctions people who mislead others. Cascioli has said he will withdraw his complaint if he receives proof of the historical existence of Christ. - AFP

Yes it is going to court.
Link to news article It will be interesting to see the outcome. Even if Jesus could be proved to have existed, it would still have nothing to do with his divinity. I would expect this to continue and to next be challenged at the World Court level should it prevail in the Italian court system. Aslan is not a Tame Lion

Considering the location of the trial, there is no doubt in my mind that the trial will not be given objective thought at all.

I'm not sure what the athiest hopes to do by filing this case, being that it won't change anyones mind.. could be wrong though

and in a country that is staunchly chatholic? Do we believe a jury will be able to divorce their religious beliefs to judge purely on the facts? I so dont think so....

ReverendDG Well if nothing else it brings into focus the full level of evidence that is available to show that Jesus existed and the validity of that evidence.

Since this was asked on another thread, here is the wikipedi article about the results Luigi Cascioli - Wikipedia
Originally, the Italian judge threw out the case, but the Court of Appeal asserted that there was a genuine case to answer. On January 27, 2006, an Italian judge began taking initial hearings to decide whether the case should be allowed to come to court. On February 9, 2006, the judge again threw out the case and recommended an investigation of Cascioli for slander against Father Righi. On March 20th, 2006, the case was re-evaluated,[1] and in July of that year Cascioli was fined by an Italian appeals court for bringing a fraudulent suit,[2] a prospect that Cascioni dismissed, saying proving the charge would still require Righi to prove Christ's existence. The European Court of Human Rights in Strasbourg has agreed to consider hearing the merits of the case.
