Yes since it is actually true.
The issue can't simply be framed as "because God is fiction."
On the issue of why atheists are atheists? It most certainly can be framed as such. The idea that atheists are atheists because they do not want to be held accountable is one that you religious types have made up. A strawman. You have never met an atheist that has given that as a reason for their non-belief. Instead, you have been given the reason that there is insufficient evidence for your god character or bible stories.
That is a belief and not a fact. Or am I again constructing a strawman.....??
Yes. No one "believes god is fiction". It is a lack of belief. There is a subtle, yet distinct difference. I find it hard to believe that, after so long on this site and after so many encounters with atheists, you are still making this tired old false argument. You know better.

Again I'll restate my point. Anyone not believing in God because they don't want to be governed by God's rules is already making the distinction that God is real and an authority in the universe. By definition this IS a believer.
That's why Hooah is saying that in no case will this be the basis for their non-belief. Because, if it was the basis of their non-belief, as I explained above, then infact they are a believer.
