Reading their filings would certainly support a plea of insanity with remand to a psychiatric institution.

Reading their filings would certainly support a plea of insanity with remand to a psychiatric institution.
To me it seems more like "diminished capacity". A few decades ago they would have been called retards or shit for brains. The fact is these people are not only stupid, but they also worship ignorance.

If I was on the jury & read that document, I would think rather than insane, the Bundies are self-centered, selfish, and spoiled brats.

Actually the lawyer did have a small point. Generally, adverse possession does not work for government held lands, but there is an exception under 43 U.S. Code 1068 that allows the Secretary of the Interior to recognize certain claims. Now it will be trivial to show that the attempt by Bundy and his folks doesn't meet the requirements of the statute to be a good faith peaceable attempt, but doing so will take a tiny bit more than saying that adverse possession is unavailable against the federal government. Plus the defense may give up more than is gained because of the twenty year period required for adverse possession to vest. Are they going to admit to an intent to occupy the facilities for at least twenty years?

The trial starts today. It will be interesting to see how long it takes to pick a jury. Trying 8 defendants at once sounds like a huge pain in the ass!
