All of their filings support a plea of insanity.
Reading their filings would certainly support a plea of insanity with remand to a psychiatric institution.

To me it seems more like "diminished capacity". A few decades ago they would have been called retards or shit for brains. The fact is these people are not only stupid, but they also worship ignorance.

If I was on the jury & read that document, I would think rather than insane, the Bundies are self-centered, selfish, and spoiled brats.

They want candy for dinner.

And now a few words from the lunatic fringe
An interesting read from the delusional conspiracy freaks. The comment section is also good for a giggle.

What have they done to Ryan Bundy?

and this:

Judge quashes Ryan Bundy’s subpoena of Gov. Brown

There is going to be a video feed from the trial to the BLM office in Burns. Sadly, there will be no recordings of the trial.

Re: Judge rules on evidence - 5 days until trial starts
That won't please the wingnuts - his attorney arguing that "the feds are coming to get you" is a paranoid delusion :-)

Could there be any greater conceit, than for someone to believe that the universe has to be simple enough for them to be able to understand it ?

Re: More pretrial manuvers

Actually the lawyer did have a small point. Generally, adverse possession does not work for government held lands, but there is an exception under 43 U.S. Code § 1068 that allows the Secretary of the Interior to recognize certain claims. See https://www.law.cornell.edu/uscode/text/43/1068

Now it will be trivial to show that the attempt by Bundy and his folks doesn't meet the requirements of the statute to be a good faith peaceable attempt, but doing so will take a tiny bit more than saying that adverse possession is unavailable against the federal government. Plus the defense may give up more than is gained because of the twenty year period required for adverse possession to vest. Are they going to admit to an intent to occupy the facilities for at least twenty years?

Cowboy Boots in Court?
The trial starts today. It will be interesting to see how long it takes to pick a jury. Trying 8 defendants at once sounds like a huge pain in the ass!

Ammon Bundy's lawyer argues for his client's right to wear cowboy boots at trial

quote:
"We would prefer our clients not look like disheveled slackers in front of the jury,'' Philpot told the judge during Tuesday's last pretrial conference hearing.

Philpot added later in the day in a written motion, "These men are cowboys, and given that the jury will be assessing their authenticity and credibility, they should be able to present themselves to the jury in that manner.''

Well, they probably wanted to be cowboys since they were little boys, but in reality they grew up to be slackers....

1st week of trial
Oregon Sheriff Testifies In Bundy Trial

quote:
Ward also said he met with Ammon and another protester, Ryan Payne, last November, and they threatened “civil unrest” if he did not intervene to stop the Hammonds from going to prison, and told him “We can’t control what they may or may not do.”

quote:
“I was told that my responsibility was to prevent them from going to prison,” Ward said. “If I didn’t do those things, they would bring thousands of people to town to do my job.”

Ward referred to the Bundy’s standoff with the BLM in 2014 and said, “The thought of that happening in my community scared the hell out of me.”

quote:
In more damaging testimony, the prosecution brought out emails written in 2015 that defendant Neil Wampler had sent to Ward, threatening that if Ward did not support the Hammonds, “the county would be invaded by some of the most determined and organized – and armed – citizens alive in this country today”. In another message, Wampler wrote: “WE AIN’T PLAYIN.”

Threat Against Harney County Sheriff Described In Testimony

quote:
Needham said that on the morning of December 7, Ryan Payne, one of the occupiers who has already pleaded guilty in the case, came to the sheriff’s office wanting to meet Ward.

Ward was away at a sheriff’s conference.

According to Needham’s testimony, Payne described his philosophy on how the federal government can’t own land and said that Sheriff Ward was not being a Constitutional sheriff. He told Needham that he needed to get rid of Sheriff Ward using any means possible, including death.

Manager of Malheur National Wildlife Refuge Testifies At Trial

quote:
He also confirmed through photographs that the men holding guns on the refuge were not government employees, leading to the larger point prosecutors are trying to prove: that the occupiers impeded federal employees while occupying the refuge.

There were dozens of photos that Karges confirmed as people who were not government employees holding large weapons.

Ammon Bundy's lawyers file motion for a mistrial, claiming 'prejudicial' testimony by Harney County sheriff

quote:
Ward explained that what he learned about the Nevada standoff "scared the hell'' out of him. The sheriff went on to note that he had discovered during a Google search on the Internet that "some unstable people who had left that situation'' killed two police officers while they were eating lunch in a restaurant.

In court, Mumford asked the judge to strike Ward's comments, arguing they were unresponsive. The judge denied his motion.

Bundy's older brother, Ryan Bundy, then stood up and objected, also asking the court to strike Ward's statements, initially citing a hearsay objection but quickly contending instead that the comments were prejudicial.

Oregon standoff: Ammon Bundy chooses to wear jail scrubs in trial

quote:
Ammon Bundy surprised the court Thursday when he showed up for trial wearing blue jail scrubs, with a pocket Constitution in left shirt pocket.

"Mr. Bundy desires to appear as he is, a political prisoner not free to dress as if presumed innocent,'' attorney J. Morgan Philpot said, reading his client's statement. "He would prefer to drop the facade and appear as the political prisoner he has been made.''

Bundy also bemoaned how he has been "shuffled around in chains," "molested like an animal," and not given the "utensils'' he needs to prepare for trial.

quote:
Controversy surrounding Bundy's attire began just before jury selection, when he objected to a U.S. Marshal's policy that he not be allowed to wear cowboy boots, a belt or necktie. In his objection to that policy, his lawyer argued that a juror could draw an inference that he was not presumed innocent as he was being held in custody and did not look like the other out-of-custody defendants.

The judge then denied his objections, and Bundy came to court in a tan suit jacket, white dress shirt and loafers.

Re: 1st week of trial
Ammon Bundy's Facebook posts revealed: 'I would never show up to a rally without my arms'

quote:
FBI agents on Friday took the witness stand to reveal some of the hundreds of thousands of Facebook posts and private messages that defendants in the Oregon standoff trial made in late December and throughout the 41-day occupation of the Malheur National Wildlife Refuge.

quote:
In several of Bundy's posts, he criticized Harney County Sheriff Dave Ward, claiming the sheriff was "collaborating with the violators," while he vowed to "do whatever it takes" to protect Harney County ranchers Dwight Hammond Jr. and Steve Hammond from having to return to federal prison on arson convictions.

Ha ha.

This thread is awesome, by the way. I'm having a great time reading these updates.
Although perhaps it should be in the "Humour" section?
