The longest time ever from nomination final Senate action is 125 days, for Mr Justice Louis Brandeis. As of today, there are 269 days until election day. I'd like to think that the majority of the population would protest a delay of that length, but the irrational level of hatred of all things Obama that teabaggers voice, I wouldn't venture to guess one way or another.

There's talk that Sri Srinivasan could be the nominee. He was confirmed to the U.S.C.A. for the D.C. Circuit three years ago by a vote of 97-0. Even this Senate would have a hard time stonewalling him for 269 days.

Note that this list includes Frank Murphy, nominated and confirmed in 1940, only 76 years ago. Note also that there were two nominated and confirmed in 1796 by a Senate that included at least two members of the Constitutional Convention that drafted our current Constitution. If they thought this was a problem, presumably they would have spoken up.

According to this article, Bork was unanimously confirmed to the U.S.C.A. for D.C. by a voice vote; nobody even asked for a roll call vote.

Waiting for the next president leaves the court short handed for more than a year. The next president won't be inaugurated until Jan 20, and it seems inconceivable that the nomination process would take less than 30 days.
