This is sort of interesting legally. I think there are tax rulings that state direct payments can be made to missionaries and be tax deductible. Now, I think calling all of his employees missionaries is probably a stretch, but there is no doubt, from his religious perspective, that the theme park is a ministry, and as a ministry, why can't he count all workers as missionaries?
I think you have just explained why the IRS was so slow acting on this. Because of the nature of what he has been doing and claiming, they would need to be exceptionally careful in building and documenting a case.
My guess is that they have a really solid case. But I guess we will have to wait and see.

is he claiming that he's being forced to show up in court illegally? like, saying the court does not have jurisdiction? that's my guess, based on the case you linked to.
I think you've got it. I think he is saying that he is being forced to act like a citizen of the USA, when he is really a citizen of heaven.
Maybe INS should charge him with being an illegal immigrant. It would be interesting to see how he played that one

I'm not sure of how much jail time.
I would expect the main outcome would be to allow the IRS to identify all of Hovind's hidden assets, and seize them.

I think you are a little confused here. There is an important difference between tax avoidance and tax evasion.
Tax avoidance is a matter of organizing your affairs so as to reduce the amount of tax you are required to pay. Many people do that, and it is quite legal. Tax evasion is failing to pay the taxes for which you are legally liable. That is not legal, and even violates the teachings of Jesus ("render unto Caesar ...").

They will probably base an appeal on the first amendment establishment clause. I expect them to lose that appeal.
