Finally, A winner declared
And, it is Now Senator Al Franken
Franken Had Most Votes, Court Says - The New York Times
ST. PAUL (AP) A special Minnesota panel of three judges from three separate courts has ruled that Al Franken, a Democrat, won the most votes in his 2008 Senate race against an incumbent Republican, Norm Coleman.
The ruling on Monday is not expected to be the final word in the case because Mr. Coleman previously announced plans to appeal to the State Supreme Court. He has 10 days to do so.
That appeal could mean a delay of several more weeks in seating Minnesota’s second senator.
After a statewide recount and a seven-week trial, Mr. Franken is 312 votes ahead. He gained more votes from the election challenge than Mr. Coleman, the candidate who filed it.
The state law Mr. Coleman sued under merely required three judges to determine who got the most votes and is therefore entitled to an election certificate. That certificate is being held up pending appeal.

Just a bit of information about the first photo.
The EXIF data in the photo shows it was taken on the 21st Dec, at 5.19pm. Not the date Tweeden claims it was taken, on the 23rd during a 36 hour flight home. It also carries a date when it was last modified. That date is the day Franken was elected. Think about that for a moment. It's been sitting on a cd, waiting for the moment it was needed, since he was elected. The current sex pest furore, and Tweeden's book deal with Sinclair is ideal. The camera was a NikonD2H. Standard issue to Army photographers at the time. You are asked to believe that a serving soldier would not only stand back and let a civilan be sexually assaulted in her sleep, but take pictures of the assault!
Within hours of Franken requesting he be investigated, Tweeden accepted his apology for any distress caused. Thus she avoided repeating her allegations under oath.

Re: Franken: Resign Now
I am going to have to give some points here. I would say , the vast majority of the time, I would agree with you. However, in lieu of the fact that the Washington Post let it be known that Project Veritas tried to scam them by having someone come over with a fake rape accusation against Roy Moore, which they rejected due to inconsistencies , and then saw her going into Project Veritas's home office, people are using accusations for political purposes. In the case of Tweeden, there is specific evidence (in the form of the exif data in the photo) that she is giving false information out. In the case of the second claim, there is the counter claim of evidence the photo given was tampered with , removing fingers from the shoulder. I would like to see if that counter argument is true before making a judgement. Those are pieces of evidence beyond 'he said she said' that indicate what 'she said' is not true.
We have evidence of dirty tricks being pulled by the Republicans for political purposes in the past, and we have claims of evidence tampering in this particular set of accusations. I don't think that politicians should roll over for dirty tricks. On the other hand, they shouldn't be given a free pass either.

Re: Guilty by statistics
When it comes to the current accusations against Franken, what strikes me out of the 5, the first two have positive evidence for them lying (the EXIF data in the photo for Tweeden in conjunction with her story, and her links to Hannity and the book deal coming out now), and the alleged photo shop of the photo of the second accusation. Numbers 3 and 4 are 'anonymous', and only to one web site that pretends to be a news organization, and number 5 the harassment claimed is not sexual in nature, but sounds more like a big disagreement
Even if number 2's photo is not modified and the claims are the fevered imagination of conspiracy theorists , the photo was right in front of the woman's husband, in public. I can't imagine that there was any solid intention there.
Since the Washington post got fake claims about Roy Moore to try to discredit them, I am going to suspect claims against politicians for a while. That isn't going to say there are women out there telling the truth, but the republican dirty tricks brigade is on the loose. I am sure the stories about Conyers are accurate. There is much much more , since congress payed out 17 million dollars in the last 20 years to settle sexual harassment claims. That's a lot of hands (and probably other parts of the anatomy) wandering.

Re: Guilty by statistics
Well,
The EXIF data and the circumstances of the first one makes the first accusation suspect.
The second one , there is the claim (I am not a photo person, so I don't know) that there is evidence that the fingers of Franken's hands were photo shopped away from her shoulder.
The next two are anonymous. .. and have only been reported through Huffpo. Considering the efforts of Project Veritas to discredit the Washington post, until better details are forthcoming, they can be discounted as insufficient evidence for the details.
When there is positive evidence the first two claims lied, and the next two claims to a single source that is not the best for sniffing out inconsistencies, and the names are being withheld, well, I need more.
While I agree with a lot of Huffington posts politics, they are not too professional with fact checking sometimes. I can see them being taken in by something like Project Veritas, which lied for political reasons.

Re: Lefties on the bullseye?
What I think is ironic is that the republicans who have done the same thing are not being asked to resign. For example, Trump had 16 accusers , with a lot worse accusations, and you don't hear anything about him from the republicans. Blake Farenthold of Texas used 84K from the budget of the Office of complience, and yet no one is asking him to resign.
So, the question is.. why aren't the Republicans and the Democrats being held to the same level of accountability?
