Several courts have in fact ruled that, for various purposes and under various circumstances, atheism can be considered a religion under the First Amendment. The Wisconsin case that johnfolton alludes to, and several cases cited by that opinion.

We can just call it intelligent design not creationism.

P.S. Great we just solved how to take religion out of evolution.
