When asked if it was lawful to pay tribute to Caesar, he said:
..... Render therefore unto Caesar the things that are Caesar's; and unto God the things that are God's.

Though we want to keep defending the religious exercise clause of the Bill Of Rights, we don't want to go down the old tyrannical road that leads to mandating religion by law.
Perhaps Huckabee's concern is activist judges who are, in effect, abrogating the exercise clause. I'm not savvy on the particulars of what his concerns are in this regard.
