While absolute proof of the fact of evolution is not achievable, the evidence is very strong in favor of it.
By a vast consensus, scientists accept this vast evidence as being valid - they accept evolution as being a fact. If these scientists are the jury, the Hovland challenge has been met (proven to beyond a reasonable doubt).
Hovland, however, lets some small minority opinion cause a hung jury. Thus, to him, there is no definitive judgment, and the fact of evolution is not proven.

Possible difinitive proof of the fact of evolution?
How about if the buildings of all anti-evolutionists are simultaneously struck by lightning (just to get their atention), and a loud, booming voice is heard world wide, saying "Evolution is a fact, you dunderheads!'.

Although that could be conceivable as a goverment effort to cover up the weakness of the theory of evolution.

But an effort of that magnitude and complexity would seem to require inteligent design. That would seem to disqualify the government as having pulled it off. Guess I'd have to default back to believing that it was indeed God's voice.

I would, however, be willing to concede that the "fact" of evolution is indeed "only" a particularly well supported part of the theory of evolution. That is, a very strong sub-theory, within a larger strong theory.
To me, the evidence within the geologic column is extremely strong evidence. Now all I need to do is drive a stake into the heart of the anti-uniformitarianism movement, and get the "flood geologists" to concede that there is no physical evidence for the "great flood" having happened.

Someone has posted this in a message at the Yahoo branch. It's a mp3 file of a Hovind debate. The file runs 29.8MB, which would take lots of hours to download on my personal slow internet connection.
