Yes, but the House is losing its mind. Since the Destruction of Marriage Amendment was defeated, the House is now looking to shore up DOMA by applying Article III, Section 2, clause 2 to it whereby Congress declares that it is beyond jurisdiction for the courts.
The House Judiciary Committee is considering three pieces of legislation, the A3S2C2 bill, a bill that will prevent the District of Columbia from recognizing same-sex marriage, and a bill that would prevent DC from implementing a domestic partnership program.
DeLay, who sponsored the new bills, said that he was afraid that by the time the Destruction of Marriage Amendment could get passed and ratified, the SCOTUS would strike down DOMA.
The bills only require simple majority of the Congress in order to take effect.
